Dzambolat Tsoriev can take part in some competitions, art. 10.12.1 of World Anti-Doping Code WADA

Many people saw competing at LOTOSHINO 2019 and wondered how is this possible considering that Dzambolat Tsoriev was banned for 10 years in 2014. Here is the answer.

According the article 10.12.1 of the WADA Code 2015, in the 2nd paragraph it’s written:

” An Athlete or other Person subject to a period
of Ineligibility longer than four years may, after
completing four years of the period of Ineligibility,
participate as an Athlete in local sport events not
sanctioned or otherwise under the jurisdiction of
a Code Signatory or member of a Code Signatory,
but only so long as the local sport event is not at
a level that could otherwise qualify such Athlete
or other Person directly or indirectly to compete
in (or accumulate points toward) a national
championship or International Event, and does
not involve the Athlete or other Person working
in any capacity with Minors.
An Athlete or other Person subject to a period of
Ineligibility shall remain subject to Testing. ”

There is an article posted on the Russian Armwrestling Federation website which clarifies this (Google Translate):

” Since Dzambolat Tsoriev has been in disqualification for more than 4 years, the head of the Anti-Doping Committee FAR, Yevgeny Khrychkin made a request to the Russian Anti-Doping Agency RUSADA dated 10.12.2018, asking for an explanation on this. In response, confirmation was received from the Russian Anti-Doping Agency on 12/20/2018 in that Tsoriev D.A. can really take part in competitions that comply with paragraph 10.12.1 of the World Anti-Doping Code WADA .

What does the phrase “local sporting events not sanctioned or otherwise non-subject to the jurisdiction of the signatory to the Code or a member of the signatory to the code” mean? In our case, these are competitions that are held without any participation of the Arm Wrestling Federation of Russia, at the local level, that is, competitions – which are held by an organization that is not a member of the HEADLIGHT and is not accredited by the Ministry of Sports of the Russian Federation. In other countries, these are any local competitions that are held without the participation of WAF , or any other organization that has a contract with WADA , and who do not have international status. ”
