Dzambolat Tsoriev

Is Dzambolat Tsoriev still banned for doping or not ?

Dzambolat Tsoriev
Dzambolat Tsoriev

In 2014 Dzambolat Tsoriev was banned for 10 years.

See all doping cases in armwrestling ► List of doping cases in Armwrestling

Dzambolat Tsoriev competed in Zloty Tur 2019 and took 5h place in the SENIOR MEN LEFT 105 KG and 4th place in SENIOR MEN RIGHT 105 kg. See ► RESULTS: ZLOTY TUR 2019, TOP 8 VENDETTA 2019 VIDEOS

Last year, Dzambolat Tsoriev also competed in Lotoshino 2019 and I made an article back then, the Russian Armwrestling Federation explained why he was allowed to compete, see ► Dzambolat Tsoriev can take part in some competitions, art. 10.12.1 of World Anti-Doping Code WADA

The problem is this article 10.12.1 of the WADA Code 2015, which is open to interpretation…

According the article 10.12.1 of the WADA Code 2015, in the 2nd paragraph it’s written:

” An Athlete or other Person subject to a period
of Ineligibility longer than four years may, after
completing four years of the period of Ineligibility,
participate as an Athlete in local sport events not
sanctioned or otherwise under the jurisdiction of
a Code Signatory or member of a Code Signatory,
but only so long as the local sport event is not at
a level that could otherwise qualify such Athlete
or other Person directly or indirectly to compete
in (or accumulate points toward) a national
championship or International Event, and does
not involve the Athlete or other Person working
in any capacity with Minors.
An Athlete or other Person subject to a period of
Ineligibility shall remain subject to Testing. ”

I think this is one of the reasons why World Anti-Doping Agency (WADA) was also criticized over the years… Anyway, if you want to watch a funny video about doping scandals over the years, here you go:

Alexey Voevoda, Anti-Doping Rule Violation confirmed

Alexey Voevoda: No Lifetime Ban, Court of Arbitration for Sport (CAS) decision

Alexey Voevoda, Anti-Doping Rule Violation confirmed
Alexey Voevoda, Anti-Doping Rule Violation confirmed

Alexey Voevoda is one of the 11 cases for which the Anti-Doping Rule Violations (ADRV) are confirmed by the Court of Arbitration for Sport (CAS).

Nevertheless, the Court of Arbitration for Sport (CAS) decided that all 11 athletes with confirmed Anti-Doping Rule Violations (ADRV) are declared ineligible only for the Olympic Winter Games (i.e. Pyeongchang 2018) instead of a life ban from all Olympic Games.

” In 11 cases, the evidence collected was found to be sufficient to establish an individual ADRV. The IOC decisions in these matters are confirmed, with one exception: the athletes are declared ineligible for the next edition of the Olympic Winter Games (i.e. Pyeongchang 2018) instead of a life ban from all Olympic Games.”

28 APPEALS UPHELD, 11 PARTIALLY UPHELD

Lausanne, 1 February 2018 – The Court of Arbitration for Sport (CAS) has delivered its decisions (operative parts only) in 39 of the 42 cases filed by Russian athletes against the decisions taken by the Disciplinary Commission of the International Olympic Committee (IOC DC) in relation to the 2014 Sochi Olympic Winter Games. The reasoned decisions will be delivered in due course. After examining each individual case, the CAS upheld 28 appeals and partially upheld the remaining 11, as follows:

Appeals upheld – no ADRV – sanctions annulled
1 Dmitry Trunenkov (bobsleigh) 24 Ekaterina Lebedeva (ice hockey)
2 Aleksei Negodailo (bobsleigh) 25 Ekaterina Pashkevich (ice hockey)

11 Evgeniy Belov (cross-country skiing) 32 Aleksei Pushkarev (bobsleigh)
12 Maxim Vylegzhanin (cross-country skiing) 33 Ilvir Khuzin (bobsleigh)
13 Alexey Petukhov (cross-country skiing) 34 Julia Ivanova (cross-country skiing)
14 Nikita Kryukov (cross-country skiing) 35 Yulia Chekaleva (cross-country skiing)
15 Alexander Bessmertnykh (cross-country skiing) 36 Anastasia Dotsenko (cross-country skiing)
16 Evgenia Shapovalova (cross-country skiing) 37 Galina Skiba (ice hockey)
17 Natalia Matveeva (cross-country skiing) 38 Anna Shibanova (ice hockey)
18 Olga Fatkulina (speed skating) 39 Inna Dyubanok (ice hockey)
19 Alexander Rumyantsev (speed skating)
20 Ivan Skobrev (speed skating) Hearing postponed
21 Artem Kuznetcov (speed skating) 40 Olga Zaytseva (biathlon)
22 Tatyana Ivanova (luge) 41 Olga Vilukhina (biathlon)
23 Albert Demchenko (luge) 42 Yana Romanova (biathlon)

Following the investigation performed by Prof. McLaren with respect to the manipulation of anti- doping procedures during the Olympic Winter Games in Sochi 2014, the IOC DC found 43 Russian athletes to have committed anti-doping rule violations during the 2014 Olympic Winter Games, disqualified them from the events in which they participated in Sochi and forfeited all medals won by them. The athletes were also declared ineligible to participate in any capacity in all subsequent editions of the Olympic Games. At the end of December 2017, all but one of the athletes (Maxim Belugin/bobsleigh) filed an appeal at the CAS.

A CAS procedure was opened for each individual athlete. Arbitral panels were constituted for each procedure and were composed of Prof. Christoph Vedder (Germany), President, Dr Dirk-Reiner Martens (Germany), and Dr Hamid Gharavi (France/Iran) for one group of procedures and Prof. Michael Geistlinger (Austria) for the second group of procedures. The remaining procedures, involving 3 biathletes, have been suspended and will be heard after the 2018 Olympic Winter Games.

The procedures were conducted jointly on an expedited basis and a combined hearing took place from 22 to 27 January 2018 in Geneva. Every athlete attended the hearing, except two who were not available, and were heard individually. Several experts and fact witnesses, such as Dr Grigory Rodchenkov and Prof. Richard McLaren, testified during the hearing.

Both CAS panels unanimously found that the evidence put forward by the IOC in relation to this matter did not have the same weight in each individual case. In 28 cases, the evidence collected was found to be insufficient to establish that an anti-doping rule violation (ADRV) was committed by the athletes concerned. With respect to these 28 athletes, the appeals are upheld, the sanctions annulled and their individual results achieved in Sochi 2014 are reinstated.

In 11 cases, the evidence collected was found to be sufficient to establish an individual ADRV. The IOC decisions in these matters are confirmed, with one exception: the athletes are declared ineligible for the next edition of the Olympic Winter Games (i.e. Pyeongchang 2018) instead of a life ban from all Olympic Games. The mandate of the CAS Panels was not to determine generally whether there was an organized scheme allowing the manipulation of doping control samples in the Sochi laboratory but was strictly limited to dealing with 39 individual cases and to assess the evidence applicable to each athlete on an individual basis.

Dzambolat Tsoriev

Dzambolat Tsoriev can take part in some competitions, art. 10.12.1 of World Anti-Doping Code WADA

Dzambolat Tsoriev
Dzambolat Tsoriev

Many people saw competing at LOTOSHINO 2019 and wondered how is this possible considering that Dzambolat Tsoriev was banned for 10 years in 2014. Here is the answer.

There is an article posted on the Russian Armwrestling Federation website which clarifies this (Google Translate):

” Since Dzambolat Tsoriev has been in disqualification for more than 4 years, the head of the Anti-Doping Committee FAR, Yevgeny Khrychkin made a request to the Russian Anti-Doping Agency RUSADA dated 10.12.2018, asking for an explanation on this. In response, confirmation was received from the Russian Anti-Doping Agency on 12/20/2018 in that Tsoriev D.A. can really take part in competitions that comply with paragraph 10.12.1 of the World Anti-Doping Code WADA .

What does the phrase “local sporting events not sanctioned or otherwise non-subject to the jurisdiction of the signatory to the Code or a member of the signatory to the code” mean? In our case, these are competitions that are held without any participation of the Arm Wrestling Federation of Russia, at the local level, that is, competitions – which are held by an organization that is not a member of the HEADLIGHT and is not accredited by the Ministry of Sports of the Russian Federation. In other countries, these are any local competitions that are held without the participation of WAF , or any other organization that has a contract with WADA , and who do not have international status. ”

VIDEO: ANAD, WADA, EAF, WAF Doping Control is a Joke or Someone is Lying ?

ANAD (Agenţia Naţională Anti-Doping) = National Anti-Doping Agency (in Romania)

According to ACCREDITED LABORATORIES – World Anti-Doping Agency, the only WADA Accredited laboratory in Romania is the Romanian Doping Control Laboratory which belongs to National Anti-Doping Agency.

EUROARM 2016: 26th European Armwrestling Championships 2016 took place in May 2016 (Competition days 24 – 28 May 2016), in Bucharest, Romania.

On 1 July 2016 there was a COMMUNICATION FROM DOPING CONTROL COMMITTEE which informed us:

” The Doping Control Committee has been informed by the Laboratory that due to technical problems, the analysis of samples taken during EUROARM2016 will be delayed.

At this date / 1 JULY 2016, no date could be given for WHEN the results will be sent to us.

The samples have all been sent and are secured at the official WADA accredited Laboratory.

The Doping Control Committee apologises for this increased delay and will inform all Federations and competitors who have been tested as soon as we get the test results.

At this moment (28 September 2016), 4 months after the EUROARM 2016: 26th European Armwrestling Championships 2016, we still don’t know the results of the doping tests, and the aforementioned communication (01 July 2016) was the last communication from the Doping Control Committee.

This is a big issue, considering that the WorldArm 2016: 38th World Armwrestling Championships 2016 is about to start and the starting lists are ready. The problem is that on these starting lists we might have some athletes who were using doping at EuroArm, but we can’t know this as long as we don’t have the doping test results from EuroArm 2016: 26th European Armwrestling Championships 2016.

There is a small chance that ANAD has nothing to do with this, maybe they weren’t actually involved in the testing process, although EuroArm took place in Bucharest, Romania. This would be strange but not impossible, considering that there is no transparency in the testing process in both EAF (European Armwrestling Federation) and WAF (World Armwrestling Federation). We never know which laboratory did the tests, we don’t have any proof that EAF or WAF really made the number of tests they claim.

This article will be sent to both ANAD and WADA, but I don’t expect to get any answers, considering that the general tendency is not really towards a clean sport, see ► WADA object to Team Sky’s idea of making TUEs public

If you feel down after reading this, I highly recommend you watch this funny video with John Oliver, (uploaded on youtube before Rio 2016 Summer Olympics) which shows many truths about doping.

WHAT YOU SEE BELOW WAS WRITTEN 1 YEAR BEFORE THE UPDATE:

As you will notice 3 names are missing from the DOPING SANCTIONS list, names that were posted last year in the DOPING RESULTS: WorldArm 2015: 37th World Armwrestling Championships 2015 (WAF):

1. Dieter SPANNAGEL / Germany

2. Elshan DADAEV / Uzbekistan

3. Georgi TSVETKOV / Bulgaria

My only guess is that these 3 names are missing from the DOPING SANCTIONS list because they all decided to fight the doping control results like Dieter Spannagel, see ► Dieter Spannagel will fight the doping control results of WorldArm 2015 WAF, Malaysia
